Firstly, the Party Wall Act covers more than just the dividing walls; it covers the space between houses, party wall fences and the dividing walls. The floor structure between flats is also a party wall. It allows owners to carry out certain work whilst at the same time protecting anyone else who might be affected by that work. If you are doing any works to a party wall you have to serve notice to the adjoining owner. There may be one or more adjoining owners for example a landlord and tenant.

A wall is a"party wall" if it stands astride the boundary of land belonging to two (or more) different owners. Some kinds of work carried out to a property may not be controlled by the Building Regulations, but may be work which is covered by the Party Wall etc. Act 1996. This is a separate piece of legislation with different requirements to the Building Regulations.
